SUB2r Camera Limited Warranty
IMPORTANT: BY USING YOUR SUB2r CAMERA, YOU ARE AGREEING TO BE BOUND BY THE
FOLLOWING TERMS OF THE SUB2R (1) YEAR LIMITED WARRANTY (“WARRANTY”)
AS SET OUT BELOW. DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE
TERMS OF THE WARRANTY. THIS LIMITED WARRANTY CONTAINS IMPORTANT
INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND
EXCLUSIONS THAT MAY APPLY TO YOU.
SUB2r One (1) Year Limited Warranty – For SUB2r Branded Product Only
WHAT IS COVERED BY THIS LIMITED WARRANTY
SUB2r Inc. (“SUB2r”) warrants the SUB2r-branded hardware product contained in the original packaging (“SUB2r Product”) against defects in materials and workmanship for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser ("Warranty Period").
WHAT THIS LIMITED WARRANTY DOES NOT COVER
This Warranty does not apply to any non-SUB2r branded hardware products or any software, even if packaged or sold with SUB2r hardware. Manufacturers, suppliers, or publishers, other than SUB2r, may provide their own warranties to you – please contact them for further information. SUB2r does not warrant that the operation of the SUB2r Product will be uninterrupted or error-free or that it will work with your specific operating system/hardware configuration and/or specific programs. SUB2r is not responsible for damage arising from failure to follow instructions relating to the SUB2r Product’s use. SUB2r's limited warranty is nontransferable and is limited to the original purchaser. This warranty gives you specific legal rights, and you may also have other rights which vary under local laws.
SUB2r does not guarantee or warrant that its products are compatible with any product not manufactured by SUB2r. SUB2r shall not be responsible for any damage to third party products as a result of use of SUB2r products. In addition, SUB2r shall not be responsible for any damage caused to SUB2r products as a result of the use of any third party products.
This Warranty does not apply: (a) to consumable parts; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (e) to damage caused by operating the SUB2r Product outside SUB2r’s published guidelines; (f) to a SUB2r Product that has been modified to alter functionality or capability; (g) to defects caused by normal wear and tear or otherwise due to the normal aging of the SUB2r Product, or (h) if any serial number has been removed or defaced from the SUB2r Product.
If during the Warranty Period you submit a valid claim to SUB2r, SUB2r will, at its option, (i) repair the SUB2r Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the SUB2r Product with a device that is at least functionally equivalent to the SUB2r Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the SUB2r Product for a refund of your purchase price.
A replacement part or SUB2r Product assumes the remaining term of the Warranty or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a SUB2r Product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes SUB2r's property.
Returns or replacements of parts and/or products may be subject to shipping, handling, replacement and/or restocking fees.
HOW TO OBTAIN WARRANTY SERVICE
Please access and review the online help resources before seeking warranty service. If that does not resolve your problem, please contact SUB2r to determine whether your problem qualifies under warranty coverage, and if it does, you will be issued RMA (Return Merchandise Authorization) number. Please do not return anything to us without an RMA, as we will not be responsible for that return.
Prepare a package to return to SUB2r; write your RMA number on the outside of the box and send to:

At SUB2r's discretion, SUB2r may cover shipping costs.
DISCLAIMER OF WARRANTIES
EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUB2R LABS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUB2R LABS ALSO LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY.
LIMITATION OF DAMAGES
IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT WILL SUB2R BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING ANY DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND SUB2R’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE ORIGINAL PURCHASER.
LIMITATION OF LIABILITY
ALL PRODUCT INFORMATION IS PROVIDED FOR YOUR CONVENIENCE,“AS IS”, AND “AS AVAILABLE”. YOU USE ALL PRODUCT INFORMATION, THE SERVICES, AND THE PRODUCT AT YOUR OWN DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE FOR (AND SUB2R DISCLAIMS) ANY AND ALL LOSS, LIABILITY, OR DAMAGES, INCLUDING TO YOUR PRODUCT PERIPHERALS, COMPUTER, AND ALL OTHER ITEMS AND PETS, RESULTING FROM YOUR USE OF THE PRODUCT INFORMATION, SERVICES, OR PRODUCT.
YOUR RIGHTS AND THIS LIMITED WARRANTY
This Limited Warranty gives you specific legal rights. You may also have other legal rights that vary by state, province, or jurisdiction. Likewise, some of the limitations in this Limited Warranty may not apply in certain states. The terms of this Limited Warranty will apply to the extent permitted by applicable law. For a full description of your legal rights you should refer to the laws applicable in your jurisdiction and you may wish to contact a relevant consumer advisory service.
This Warranty is governed by the laws of the State of California and by United States federal law without regard to conflicts of laws principles. Any litigation relating to this warranty shall be subject to the exclusive jurisdiction of the state or federal courts in San Francisco, California, U.S.A. The United Nations Convention on the International Sale of Goods is expressly excluded from application to this Warranty.
